California Safer Food Packaging and Cookware Act of 2021
As the state of California continues its push to protect the health of its citizens, lawmakers have passed measures that aim to reduce the number of toxic chemicals in food packaging. The new law, known as the California Safer Food Packaging and Cookware Act of 2021, prohibits the sale of plant-based food packaging that contains PFAS chemicals.
AB 1200 is the first law to require cookware manufacturers to reveal what they’re using in their products. This is done through the use of a website and a product label. These two steps are the first step to ensuring that consumers have all the information they need to make an informed purchase.
AB 1200 requires that a manufacturer of cookware in California disclose all hazardous and other potentially harmful materials that may be contained in the product. This is done through a product label that includes a graphic and written material.
The aforementioned website is also an online listing of Candidate Chemicals, which are substances that are listed by the California Department of Toxic Substances Control. Those substances can be included on the list for technical reasons, but the new laws will require manufacturers to identify all the chemicals they use in their products.

Hazardous Packaging Law
The Hazardous Packaging Law is part of New York State’s Environmental Conservation Law. This legislation sets limits on the concentration of heavy metals in consumer products. In addition, it regulates the distribution of food packaging.
The act is designed to protect New Yorkers from the harmful effects of toxic materials in the waste stream. It sets limits on the amount of four toxic heavy metals: cadmium, lead, mercury, and hexavalent chromium.
It also requires manufacturers to conduct lab tests to ensure that the products they produce are safe. They must maintain records of these tests. Manufacturers should also provide certificates of compliance.
As of December 31, 2022, the new Act will ban the use of per- and polyfluoroalkyl substances (PFAS) in food packaging. PFAS are chemicals that are known to be carcinogens. However, New York State will not regulate the usage of PFAS in food packaging for another two years.
Food packaging is defined as any package, crates, or containers intended for direct food contact. This includes paperboard, pastry boxes, pizza boxes, and trays. Moreover, food packaging cannot contain glass or plastic.
It is important for the purchaser of packaged goods to check for compliance with the law. Exceptions may apply to certain packages. For example, products manufactured by suppliers in accordance with federal law may qualify for exemption.
It is not recommended that consumers purchase products that are not fully compliant with the Hazardous Packaging Law. These laws are not only protecting New Yorkers, but they are protecting the environment.
